LEGAL INFORMATION OF FUNDACIÓN BANCARIA CAIXA D’ESTALVIS I PENSIONS DE BARCELONA “LA CAIXA”
Fundación Bancaria Caixa d’Estalvis i Pensions de Barcelona, ”la Caixa” (hereinafter, ”la Caixa” Banking Foundation), with NIF G-58899998. It is entered in the Register of Foundations of the Ministry of the Presidency, Justice and Relations with the Courts under number 1,658, and in the Barcelona Mercantile Register, volume/I.R.U.S. 1000098265988, folio 32, page B 5614. It is subject to the supervision of the Banking Foundations Protectorate of the Ministry of Economy, Trade and Enterprise, and has its registered office in Barcelona, Avenida Diagonal, numbers 621–629, Tower II, postal code 08028.
The main activity of “la Caixa” Banking Foundation is aimed at carrying out and developing social work and the appropriate management of its holding in CaixaBank, S.A., pursuant to the provisions in Act 26 of 27 December 2013 on savings banks and banking foundations.
WHAT IS TUMO BILBAO-BIZKAIA CENTRE
TUMO – Center for Creative Technologies is an extracurricular, in-person educational program distinguished by its inclusive and philanthropic nature (free of charge and open to youth aged 12 to 18) and by its pedagogical model, which puts young people in charge of their own learning through three interdependent methods: (i) learning, accompanied by learning coaches; (ii) workshops, guided by workshop leaders; and (iii) advanced laboratories, involving national and international specialist professionals.
This program is implemented in Spain, specifically in Bilbao-Bizkaia, by “la Caixa” Foundation under the name “Centro TUMO Bilbao-Bizkaia,” with the collaboration of the Provincial Council of Bizkaia (Diputación Foral de Bizkaia) and the Bilbao City Council. The program incorporates
a firm commitment to vulnerable groups, preferentially promoting the participation of students in situations of vulnerability and/or risk of social exclusion.
GENERAL TERMS AND CONDITIONS
Object and Scope of Application
These general terms and conditions (hereinafter, the “General Conditions”) detailed in this document regulate the use of the website accessible at https://bilbaobizkaia.tumo.es/ (hereinafter, the “Website”).
The provisions of this document shall apply to all persons (hereinafter, the “Users”) who access the Website, whether for purely informational purposes or to formalize a pre-registration as a legal guardian (hereinafter, “Legal Guardian”) on behalf of their wards (hereinafter, “Students”) in the activities organized by the TUMO Bilbao-Bizkaia Center.
The use of the Website and, where applicable, the formalization of pre-registration for activities at the TUMO Bilbao-Bizkaia Center through it, implies the full acceptance of these General Conditions, without prejudice to any other documents that must be expressly accepted by the Legal Guardian during the registration process.
Access to the TUMO Bilbao-Bizkaia Website
Although access to the Website is free, access to the catalog of activities and interaction with the content developed at the TUMO Bilbao-Bizkaia Center require prior pre-registration through the Website by the corresponding Legal Guardians.
For the purposes of these General Conditions and this program, a Legal Guardian shall be understood as the person responsible for the Student. In this regard, the following shall be considered as such: a) the Student themselves, provided they are of legal age; b) the father or mother of the minor; c) the person to whom parental responsibility has been assigned by judicial decision; d) whoever holds legal custody of the minor; e) another adult duly authorized in writing by the parents or by judicial decision.
In this sense, Users performing the registration declare and warrant that (i) they are of legal age and hold the status of Legal Guardian and/or have the proper authorization to act as such; and (ii) all information provided is true, accurate, current, and authentic, and, where applicable, that they possess the necessary authorizations and commit to keeping it duly updated.
Furthermore, Users agree to use the Website correctly, diligently, and in compliance with the law, good faith, and public order, respecting the purpose of the Website at all times.
PRE-REGISTRATIONS AND ADMISSION
Eligibility Criteria and Requirements
Young people aged between 12 and 18, residing in the Historical Territory of Bizkaia and neighbouring territories, may pre-register for activities at the TUMO Bilbao-Bizkaia Center.
The TUMO Bilbao-Bizkaia Center preferentially promotes the participation of students in situations of vulnerability and/or at risk of social exclusion. In these cases, the selection model incorporates a prioritization system based on objective evaluation criteria obtained from the information provided by the Legal Guardian via the pre-registration form. In the event of a tie in points, the order of application receipt will be used as the tie-breaking criterion.
In all other cases, the eligibility criterion is the order of registration and the availability of a compatible schedule. All of this is subject to space availability, with the possibility of being placed on a waiting list.
Pre-Registration Process
The pre-registration process for activities at the TUMO Bilbao-Bizkaia Center consists of the following steps:
- Online Form: Filling out the details of the legally responsible person (Legal Guardian) and the Student(s);
- Schedule Selection;
- Enrollment and Formalization of Registration.
Following the analysis of applications, the definitive assignment of the spot and corresponding schedule will be communicated to applicants, and the necessary contractual documents for the formalization of registration will be provided.
Free-of-Charge Nature and Type of Activity
The activities at the TUMO Bilbao-Bizkaia Center are completely free of charge; therefore, there are no registration fees, tuition, or monthly payments.
Participation in educational activities at the TUMO Bilbao-Bizkaia Center does not grant the legal status of a student in formal education, but rather falls within the framework of non-formal education and educational leisure time.
Modification of Contact Details
Any modification to the contact details of the Legal Guardian or Student that may affect the execution of the agreement or the correct fulfillment of activities at the TUMO Bilbao-Bizkaia Center—in particular, changes of address, email, or telephone number—must be communicated to the TUMO Bilbao-Bizkaia Center.
WEBSITE LEGAL NOTICE
Validity of Information and Content
The information contained on the Website is that which is current as of the date of its last update.
These General Conditions are current from the date of their last update. Users will be subject to the General Conditions in force at the moment they use the web page or complete the pre-registration.
The content of the Website, especially informational and promotional references, where applicable, does not constitute any type of binding offer unless expressly stated otherwise. “la Caixa” Foundation reserves the right to introduce modifications or partially or totally omit the current content when it deems appropriate, as well as to block or restrict access temporarily or permanently.
“la Caixa” Foundation may include third-party content and links to third-party web pages on any of its Websites, always with the authorization of their owners, such as to social networks and other information. In none of these cases shall “la Caixa” Foundation be responsible for third-party pages and content, or for their functionality and availability.
In the event that the Website allows users to input content, “la Caixa” Foundation reserves the right not to publish, withdraw, or delete any content it considers incorrect, inaccurate, or contrary to this Legal Notice.
Users may not include content on the Website regarding religious beliefs or political ideas (including statements and symbols of political parties and religious organizations), or content that is antisocial, offensive to cultural or religious values, provocative, derogatory, violent, obscene, sexual, and/or related to groups that are not socially acceptable or are illegal. Likewise, they may not include any content that could offend the sensibilities of third parties, violate fundamental rights and public freedoms recognized by applicable regulations and/or those established in legislation regarding consumer and user rights, the protection of children and youth, or constitute an intrusion into the personal or family privacy of natural persons, or a violation of the right to honor of third parties or the secrecy of communications. In any case, the User shall be solely responsible for the opinions expressed as well as for their veracity, accuracy, and/or legality.
The inclusion of content subject to copyright and image rights is conditioned upon the user holding sufficient legitimacy and obtaining the necessary authorizations so that the content can be used, both by themselves and by other users, under the terms provided in this Legal Notice, and that its use does not imply a violation of any legal provision, contract, third-party rights or property, or constitute unfair competition in any way.
Consequently, by the fact of including content on the Website, it shall be understood that the User who includes it possesses the aforementioned legitimacy.
Privacy Policy and Data Protection
Registration Process
Users will be duly informed, within the framework of the pre-registration and registration process, about the processing of their personal data, as well as the exercise of their rights regarding personal data protection in accordance with the provisions of Article 13 and subsequent articles of the European General Data Protection Regulation.
Resolution of Queries and Inquiries
Fundación Bancaria Caixa d’Estalvis i Pensions de Barcelona, ”la Caixa”, with its registered office at Avenida Diagonal, 621-629, 08028 Barcelona, Spain, acts as the data controller for personal data for the resolution of queries and inquiries related to this program. The legal basis for processing is the performance of a contract at the request of the applicant. Personal data will be retained until the applicable statute of limitations expires. Data will only be communicated to fulfill legal obligations, as well as to third-party providers acting in their capacity as data processors. Access to such data by technology providers located outside the European Economic Area is backed by all required legal guarantees. Further information may be requested, or rights of access, rectification, erasure, restriction, portability, and objection may be exercised before the Data Protection Officer of the “la Caixa” Banking Foundation at Avenida Diagonal, 621-629, 08028 Barcelona, or by writing to dpd@fundacionlacaixa.org. You may also lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).
Video Surveillance
In the event that video surveillance cameras are installed at the TUMO Bilbao-Bizkaia Center, users will be informed upon entry and in accordance with data protection regulations that, among other things, the images captured through these systems will become part of a file under the responsibility of “la Caixa” Foundation for the purpose of access control and security of the Center and the Activity, as well as the resolution of any incidents. The user may exercise their rights of access, erasure, and restriction regarding their data and its processing before “la Caixa” Banking Foundation at the email address dpd@fundacionlacaixa.org or at the postal address Avenida Diagonal, numbers 621 – 629, Torre II, 08028 Barcelona (Spain).
Mobile Portals and Geolocation
Some of the Websites of “la Caixa” Foundation are adapted for use on mobile devices, so the layout and content of the different mobile applications may not match or be identical to those of the portal or the various web pages.
Furthermore, some of the Websites or applications may feature geolocation functions to determine the location of said device at any given moment when activated by the user. This allows access to services that require geolocation and that “la Caixa” Foundation has available.
Access to these services will require the User to activate the geolocation function on their mobile device, which can be deactivated at any time.
Intellectual and Industrial Property Rights of the Website
The Websites of “la Caixa” Foundation, the pages they comprise, and the information or elements contained therein include texts, documents, photographs, drawings, graphic representations, databases, computer programs, as well as logos, trademarks, trade names, or other distinctive signs protected by intellectual or industrial property rights, of which the Foundation, its Group companies, or TUMO are the owners or legitimate licensees.
“la Caixa” Foundation grants no warranty regarding the lawfulness and legality of the information or elements contained on the Websites of “la Caixa” Foundation when the ownership of the same does not belong to it or to its Group companies.
Prohibited and Permitted Uses
Any form of exploitation, including any type of reproduction, distribution, assignment to third parties, public communication, and transformation, by means of any type of medium or format, of the aforementioned works, creations, and distinctive signs is prohibited without the prior and express authorization of their respective owners. Failure to comply with this prohibition may constitute an infringement punishable under current legislation.
However, at their own risk, the User may download or make a copy of such elements exclusively for personal use, provided that it does not infringe upon any of the intellectual or industrial property rights of “la Caixa” Foundation. Specifically, they may not alter, modify, or delete them, either totally or partially. In no case shall this signify an authorization or license over its property rights or those of its Group companies.
Except in cases expressly authorized by “la Caixa” Foundation, it is prohibited to establish links or hyperlinks from third-party portals or websites to the Website or to web pages of “la Caixa” Foundation other than the main page of its portal, accessible at the URL
(https://fundacionlacaixa.org/), or whichever replaces it in the future, as well as to present them or the information contained in them under frames, distinctive signs, trademarks, or corporate or commercial names of another person, company, or entity.
Liabilities
“la Caixa” Foundation does not guarantee, to the extent permitted by applicable legislation, continuous access, or the correct display, download, or utility of the elements and information contained on its web pages, which may be impeded, hindered, or interrupted by factors or circumstances beyond its control.
“la Caixa” Foundation is not responsible for the information and other content integrated into third-party spaces or web pages accessible from the Website via links or hyperlinks, nor for the information and other content integrated into third-party spaces or web pages from which its Website or any of its web pages are accessed via links or hyperlinks, nor for the information and content of any third-party web page presented under the appearance or distinctive signs of “la Caixa” Foundation, unless expressly authorized by the latter.
To the extent permitted by applicable legislation, “la Caixa” Foundation and its third-party information providers assume no liability regarding the information, content of all kinds, products, and services offered or provided through the Website of “la Caixa” Foundation by third parties or entities, even if they belong to the same Group, and especially for damages of any kind linked to the foregoing that may arise due to: (i) the absence or deficiencies in the information provided to users or in its veracity, accuracy, and sufficiency; (ii) breach or defective or untimely compliance with contracts or pre-contractual relationships; (iii) non-compliance with
obligations incumbent upon information society service providers; (iv) infringement of consumer and user rights; (v) infringement of intellectual and industrial property rights; acts of unfair competition or unlawful advertising; (vi) infringement of data protection rights, professional secrecy, and the rights to honor, personal and family privacy, and the image of persons; (vii) in general, non-compliance with any laws, customs, or codes of conduct that may apply; and (viii) any decision made in reliance on the information provided through this website.
Neither “la Caixa” Foundation nor third-party information providers assume any liability for damages, losses, claims, or expenses caused by: (i) interferences, interruptions, failures, omissions, telephone breakdowns, delays, blockages, or disconnections in the operation of the electronic system caused by deficiencies, overloads, and errors in telecommunications lines and networks, or due to any other cause beyond its control; (ii) illegitimate intrusions through the use of malicious programs of any kind and through any communication medium, such as computer viruses or any others; (iii) improper or inappropriate use of the Website; (iv) security or navigation errors caused by a malfunction of the browser or by the use of outdated versions thereof.

Applicable Legislation
The use of the Website and the pre-registration and/or registration process through said Website shall be governed by Spanish legislation.
